“Al met al is de GCV van mening dat het noodzakelijk is de regeling betreffende liquidatie en insolventie beter uit te werken. Er zijn sterkere waarborgen vereist om te voorkomen dat de vereenvoudiging ten koste gaat van rechtszekerheid en schuldeisersbescherming. Er dient voorkomen te worden dat vennootschappen met andere rechtsvormen zich omzetten in een “EU Inc.” om te profiteren van een flexibeler insolventieregime.”
